2. Joint Controllers for Events, Contact Information

SPECTARIS informally supports the services provided by SPECTARIS GmbH in connection with events recommended by SPECTARIS. SPECTARIS and SPECTARIS GmbH jointly process the personal data collected or used in this context. The Data Protection Officer also serves as the single point of contact for data subjects regarding the processing of personal data by SPECTARIS GmbH in accordance with No. 2.

II. Information About Data Processed by SPECTARIS

4. Purpose of Data Processing and Legal Bases

4.1. SPECTARIS processes personal data

• to promote the association’s purpose as set forth in Section 2 of its bylaws, namely to support industrial sectors in the fields of optical, medical, and mechatronic technologies, and in particular the subfields of consumer optics (optometry), photonics, medical technology, and analytical, biological, and laboratory technology. This support is provided primarily through informal, communicative, and organizational measures, such as the exchange and sharing of information, contacts, and market access; the networking of stakeholders and interested parties; the organization of events; and public relations activities. This support is provided primarily to SPECTARIS member companies and their employees, as well as to stakeholders and interested parties in the aforementioned industrial sectors, other market participants, the scientific community, policymakers, government agencies, society, and the general public;

• to establish, maintain, or terminate membership relationships;

• to establish, carry out, or terminate employment relationships;

• to establish, perform, or terminate other contractual relationships;

• to fulfill obligations arising from legal requirements related to the purposes mentioned above, such as tax, social security, regulatory, or administrative laws.

4.2. SPECTARIS GmbH processes personal data in connection with No. 2 for the purposes of organizing, inviting participants to, and communicating about events.

4.3. Processing for the purposes specified in sections 4.1 and 4.2 is carried out

• based on the consent of the individuals concerned (see Art. 6(1)(a) of the GDPR),

• because this is necessary for the performance of a contract with the data subjects or for the implementation of precontractual measures taken at the data subjects’ request (see Art. 6(1)(b) of the GDPR)

• because this is necessary to safeguard the legitimate interests of SPECTARIS or third parties (see 4.4.), unless the interests, fundamental rights, or fundamental freedoms of the data subjects that require the protection of personal data take precedence (see Art. 6(1)(f) of the GDPR) or

• because this is permitted or required by other laws.

4.4. SPECTARIS’s legitimate interest is, above all, to promote the association’s purpose as described above.

SPECTARIS GmbH is authorized, above all, to promote its corporate purpose, in particular by organizing events recommended by SPECTARIS.

The legitimate interests of third parties primarily include the interests of SPECTARIS member companies and their employees, as well as the interests of individuals and companies in the fields of optical, medical, and mechatronic technologies—as represented by stakeholders from business, science, politics, government agencies, and society, as well as those of consumers, regarding the economic sectors represented by SPECTARIS, the technology manufactured in this field, and the related developments, advancements, and funding instruments—to be informed, supported, and connected.

The legitimate interests of third parties also include the interests of SPECTARIS’s contractual partners and SPECTARIS GmbH, including their employees, in establishing and/or managing contractual relationships with SPECTARIS for the purpose of promoting the association’s objectives or in connection therewith, and/or with SPECTARIS GmbH in connection with the organization of and participation in events.

5. Categories of Data That Are Processed

5.1 In particular , company names, names, or other designations of natural and legal persons, their contact information (such as mailing addresses, phone and fax numbers, and email addresses, etc.), data required for the processing of payment services (such as bank and account information, etc.), data required for financial and payroll accounting (such as dates of birth, tax or social security numbers), as well as other personal data serving the processing purpose specified in Section 4.

5.2 In the event of the use of (electronic/digital) services and tools for direct and indirect information, communication, and organization, with or without audio and video capabilities (telephone and video conferences, video calls, webinars, web conferences, newsletters, networking services, business and event management services, cloud services, etc.), the following also applies:

• personal data that participants provide themselves, such as information about themselves and their circumstances, as well as the device and software they use to access these services and resources—for example, the IP address of your device, the operating system version, the device identifier, the browser type, and information about your location and duration of use;

• Personal data that forms part of the content of the communication, to the extent that it is evident from the chat history and the chat history is logged—for example, because it contains work instructions, questions to be clarified later, or similar information.

5.3 Job Applications
As part of the application process, we process personal data that applicants submit to us either by mail or by email. This data is processed solely for the purpose of conducting the selection process. A fair and objective assessment is important to us. Therefore, we ask that you voluntarily refrain from providing information on topics such as ethnic origin, religion or beliefs, genetic or biometric characteristics, health status, and sexual orientation.

Legal Basis
Data processing is based on the following legal grounds:

Article 88 of the GDPR in conjunction with Section 26(1), first sentence, of the Federal Data Protection Act (BDSG)

Recipients of the data
. Within our company, access to your data is limited exclusively to those individuals who are involved in the selection process or have been entrusted with it.

Retention Period and Deletion
If a candidate is hired, the data collected during the application process is transferred to the personnel file and continues to be used within the context of the employment relationship.
If an employment relationship is not established, we generally delete the data six months after sending the rejection notice, unless legal provisions or a legitimate interest—such as for defense in proceedings under the AGG—require longer retention.
If you have given us your explicit consent to store your application for future job openings, we will retain your documents for up to one year. After that, they will be permanently deleted.

6. Categories of Recipients; Data Processors

6.1. Natural and legal persons with whom SPECTARIS cooperates, communicates, or is contractually or de facto associated for the processing purpose specified in Section 4, in particular SPECTARIS member companies, their employees, as well as the third parties listed therein and the general public.

6.2. SPECTARIS works with data processors in this regard, particularly when using telemedia services as described in Section 5.2. These are primarily providers of communication services, database and communication software, as well as providers of cloud services on which this software is hosted. For this purpose, personal data may be transferred to the data processors as necessary. The data processors are subject to SPECTARIS’s instructions regarding the manner in which this data is processed and are obligated to SPECTARIS to delete this data once the purpose of communication has been achieved or upon instruction, unless and to the extent that contractual agreements with the service providers or statutory provisions provide otherwise, or instructions from public authorities based on such provisions mandate otherwise. Deviations may also arise in the case of data processors that are not based in EU member states. Information regarding these is provided explicitly in Section III.

7. Duration of Storage

SPECTARIS itself stores personal data only for as long as the data subjects have given their consent, or for as long as this is required, necessary, or permitted to fulfill the purposes of processing and within the scope of the legal bases set forth in No. 4.

If these conditions are no longer met, such data will be deleted.

The duration of data storage and the deletion of data are subject to the proviso that no statutory provisions regarding their retention or deletion permit or require otherwise.

8. Rights of Data Subjects

Data subjects whose personal data is being processed may have the following rights with respect to SPECTARIS: the right to access their personal data, the right to have such data corrected, the right to have such data erased, the right to restrict the processing of such data, and the right to data portability.

9. Right to Withdraw Consent; Right to Object

If data subjects have consented to the processing of their personal data by SPECTARIS, they have the right to withdraw their consent at any time.

If the processing is carried out in the overriding interest of SPECTARIS or a third party, you also have the right to object to such processing for reasons arising from a particular situation of the data subject.

The revocation or objection must be submitted in writing or in text form to SPECTARIS using the contact information provided in Section I, No. 1.

10. Right to File a Complaint with the Supervisory Authority; Legal Remedies

Data subjects have the right to lodge a complaint with a data protection supervisory authority in their Member State, their place of residence, their place of work, or the location of the alleged infringement if they believe that the processing of their personal data violates the GDPR. They also have the right to seek judicial remedy if they believe that their rights under the GDPR have been infringed by the processing of their personal data in a manner that does not comply with the GDPR.

11. Sources

SPECTARIS processes personal data primarily

• based on information provided by the individuals concerned or by the recipients referred to in No. 6, particularly in connection with communication aimed at promoting the association’s purpose, such as electronic, postal, or in-person communication (e.g., business cards), provided that such communication is not expressly or clearly intended for purely private purposes;

• from publicly available sources, in particular from directories in which information about companies, government agencies, or individuals is made public by them either voluntarily or pursuant to legal requirements, such as legal notices on websites or social media platforms, or public directories/registers.

12. Contact Form, Newsletter, and Registration

The data entered into the fields of our contact form (https://www.spectaris.de/verband/kontakt), when subscribing to our newsletter (https://www.spectaris.de/verband/newsletter-verband), or when registering for a user account (https://www.spectaris.de/registration) will be processed by SPECTARIS only under the circumstances specified in sections 1–11 above.

13. Cookies and Plug-Ins

The programs that display our websites via the domains , https://www.spectaris.de, and their subdomains when accessed through a web browser—and which are stored on our web server (our websites)—use so-called cookies and plug-ins. These are files or functions that can place and exchange information between our websites or our web server and the visitor’s web browser, or program elements on our website from operators of other websites (e.g., “social media”) that establish a connection to the servers of the operators of these other websites and thereby facilitate the exchange of information collected during a visit to our website (e.g., IP addresses). These cookies and plug-ins originate from the data processors or companies listed in Section 17. Their use also results in the data processing described above by these same data processors or companies.

14. Communication Services

For the purposes of communication as described in Section 6.2 and Section 12, we use the services of the data processors or companies listed in Section 17. In doing so, personal data as listed in Sections 5 and 13 is also processed, including by these same data processors or companies.

This includes, in particular, the data generated by the participants themselves through their use of these services.

15. Transfer to Third Countries, Risk Notice

Data processing in accordance with sections 13 and 14 also involves the transfer of data to data processors and companies that are not based in EU member states (third countries).

Please note that, with regard to personal data—in particular the data mentioned in Section 5.2—this may result in processing over which we have no control (e.g., profiling). Such processing is subject to the legal regulations in effect in the respective third country. There is no adequacy decision by the European Commission, nor are there adequate safeguards in accordance with the GDPR. This generally entails legal and practical risks for data subjects, particularly with regard to asserting and enforcing claims and rights, especially concerning their personal data.

16. Consent

Consent Management Tool
We use a consent management tool on our website. This tool allows you to grant consent to data processing via the website—in particular, the use of cookies—and to exercise your right to withdraw consent that has already been granted. The purpose of this data processing is to obtain and document the necessary consents for data processing and thereby comply with legal obligations. Cookies may be used for this purpose.
Among other things, the following information is collected and transmitted to an external server operated by elbgraphen Werbeagentur GmbH: the date and time the page was accessed, a random ID, and consent status. Papoo Software & Media, as the publisher, and elbgraphen Werbeagentur, as the operator, do not process the data themselves; the data is stored as a log file. Access to the log files is granted only upon prior consultation with and consent from the customer. This data is not disclosed to any other third parties. Data processing is carried out to fulfill a legal obligation pursuant to Article 6(1)(c) of the GDPR.

17. Data Processors and Companies in Detail

17.1. Our web host, Mittwald CM Service GmbH & Co. KG, located at Königsberger Straße 4-6, 32339 Espelkamp, uses cookies to generate so-called server log files—that is, files containing information exchanged during communication between the visitor’s web browser and our web server when the visitor accesses our website. This includes the IP address currently assigned to your device, the date and time of the request, the time zone, the specific page or file accessed, the HTTP status code, and the amount of data transferred; in addition, the website from which your request originated, the browser used, the operating system of your device, and the language setting. This data collection occurs without our initiative and without our influence.

17.2. Our website uses Google Analytics, Google Maps, and Google reCAPTCHA. These are services provided by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. Google Analytics is an analytics service that collects information generated when you visit our website. Google Maps is used to display our location and to provide directions. Google reCAPTCHA is used to distinguish whether an online action is performed by a human or by a computer program (bot), and to recognize and digitize handwriting and characters. Through the connection to Google established via these services, Google can determine from which website your request was sent and to which IP address the directions should be transmitted. In the process, data is also transferred to Google. Please note that, as the provider of our website, we have no knowledge of the content of the transmitted data or its use by Google. 17.3. This website uses the open-source web analytics service Matomo. Matomo is an “open-source platform distributed by the main developers listed at https://matomo.org/team.” We use Matomo as a self-hosted version. Matomo does not use cookies. The IP address is also anonymized before transmission. The website operator has a legitimate interest in the anonymized analysis of user behavior in order to optimize both its website and its advertising. Information regarding the use of this website is not shared with third parties.

17.4. Our website uses YouTube plugins to embed and display video content. The video portal is provided by YouTube, LLC, 901 Cherry Ave., San Bruno, CA 94066, USA. When you visit a page with an embedded YouTube plugin, a connection is established to YouTube’s servers. This allows YouTube to determine which of our pages you have visited. YouTube can directly associate your browsing behavior with your personal profile if you are logged into your YouTube account. You can prevent this by logging out beforehand. We have no knowledge of the content of the data transmitted or how YouTube uses it.

17.5. We use the services of SurveyMonkey Europe UC, 2 Shelbourne Buildings, Second Floor, Shelbourne Rd, Ballsbridge, Dublin 4, Ireland—a subsidiary of SurveyMonkey Inc., 1 Curiosity Way, San Mateo, California 94403, USA—to conduct surveys. 17.6 For stationary and mobile VoIP conference calls, digital video conferences, webinars, and cloud-based group work and communication, we use the following services and products:

What data is processed?

Various types of personal data may be processed in connection with the use of Microsoft Teams. These include, among others:

Information about meetings, chats, shared files, voice messages, recordings, and transcripts
Contact information such as name, email address, profile picture, and phone number
Call Transcripts and Call Quality Data
Support and feedback data related to technical issues or feedback provided to Microsoft
Diagnostic and telemetry data regarding the use of the service

To transmit video and audio, Microsoft Teams processes audio and, if applicable, video data from your device for the duration of the session. You can disable the microphone and camera at any time directly within the application.

Legal Basis for Processing

The processing of your data in connection with Microsoft Teams is based on the following legal grounds:

If an online meeting is being recorded, we will inform you in advance and, if necessary, obtain your separate consent. Participation is, of course, voluntary—you may leave the meeting at any time.

Processing by Microsoft

As a cloud-based service, Microsoft processes the data listed above to provide and improve its services. To the extent that Microsoft uses personal data for its own business purposes, the company acts independently as a “data controller” and is responsible for complying with the relevant data protection regulations.

If you visit the Microsoft Teams website to use Microsoft Teams (e.g., to download the software or when using a browser), data processing is also carried out under Microsoft’s responsibility.

Data Transfer to Third Countries

Microsoft is certified under the EU-U.S. Data Privacy Framework. Based on this, the European Commission has issued an adequacy decision pursuant to Article 45 of the GDPR, which permits the transfer of personal data to the United States without the need for additional safeguards.

(d) Use of Microsoft 365 for internal collaboration

For internal communication and collaboration, we use Microsoft 365, a cloud-based service provided by Microsoft Ireland Operations Limited, One Microsoft Place, South County Business Park, Leopardstown, Dublin 18, D18 P521, Ireland (“Microsoft”).

We use the following applications: Access, Excel, OneNote, Outlook, PowerPoint, Publisher, Sway, Word, OneDrive, Skype for Business, Microsoft Teams, and Planner. These applications are used primarily for creating, editing, and sharing documents, as well as for internal communication.

The processing of personal data (e.g., user information, the content of emails or documents, as well as usage and metadata) generally takes place on servers located within the European Union. Processing in third countries, particularly in the United States, cannot be ruled out in individual cases; however, it is carried out exclusively in compliance with the data protection requirements set forth in the General Data Protection Regulation (GDPR), specifically based on the Standard Contractual Clauses (SCCs) approved by the European Commission.

We use Microsoft 365 via our own domain and a central tenant account, and no external partners or organizations are integrated into the Microsoft 365 environment.

We have a contract with Microsoft for data processing on our behalf in accordance with Article 28 of the GDPR. Data processing is carried out exclusively in accordance with our instructions and within the framework of applicable data protection regulations.

17.9.For work processes, the exchange of information, and communication with and among our officers, employees, our members, and their officers and employees, as well as with third parties within the scope of our association’s purpose, we use our own association-specific network,“myspectaris.” For this purpose, we in turn use the“tixxt”cloud and communication services provided by mixxt GmbH, Adenauerallee 134, 53113 Bonn. October 17 For the organization of in-person, virtual, and hybrid events—in particular exhibitions, career fairs, job fairs, and sponsor events—and for the networking and communication of individuals and legal entities for this purpose, as well as for the processing of the data and information exchanged for this purpose, we use the“b2match” service provided by B2Match GmbH, Mariahilfer Strasse 17, AT-1060 Vienna, Austria. This service primarily consists of making proprietary software and third-party cloud storage services available for this purpose. As part of your registration on mySPECTARIS, we may add you to various groups or mailing lists to keep you informed. If you are not interested in being added to such groups, you can easily prevent this by exercising your right to opt out. To do so, please send an email to Mr. Hülbrock (huelbrock@spectaris) with the subject line “Opt-Out Groups,” listing the groups you wish to leave and your name. When you visit the page shop.spectaris.de, a connection is established with Shopify’s servers. SPECTARIS only requests your name, address, and email address as part of the checkout process. SPECTARIS deletes this data once the checkout process is complete.
